Contest Rules (Terms and Conditions)
1. Contest Period
The House Contest begins at 5 p.m. Eastern Time on 13 June, 2019 and ends at 12 p.m. ET on 31 October, 2019. We may extend the contest to November 13, 2019. (the “Contest Period”). Contest duration: 2 (two) months with the possibility of an extension to a maximum of 5( five) months. A minimum amount of 50,000 entries must be received by the end of the contest. The House Contest will only be extended if entry fees collected are very close to minimum amount at the end of 2 (two) months
By participating in the Contest, each entrant agrees to abide by and be bound by these House Contest Rules.
The Contest is open to legal residents of Canada (excluding Quebec) who have reached the age of majority in their province or territory of residence as of the date of entry. Excluded from eligibility are the officers, directors, employees, agents and representatives of the Sponsors being 10235881 Canada Inc., A McIntosh and C McIntosh (collectively the “Sponsor”) and members of any immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of the Sponsor and any officers, directors, employees, agents and representatives of 10235881 Canada Inc. Further excluded from eligibility are the judges of the House Contest and members of any immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of the judges.
Participants from other countries are advised to research the tax laws of your native country to determine any tax ramifications resulting from winning the contest before submitting your entry.
3. How to Enter
Entry fee $25.00 (Canadian):
1: use on-line entry form and pay by credit card;
2: if submitting an E-Letter, E-transfer funds to CONTEST trust account email: firstname.lastname@example.org; or
3: enclose with your letter a Canadian bank cheque, money order or bank draft and mail to:

Answer the three questions and write your short (maximum 100 word) story.
Write a statement explaining what winning this house will mean to you and your family - why you should Win This House and how will pay it forward. Keep your story to 97 words or less. If you can say what you want to say in 5 words, that's great. If you use every word, that's great, too. Just don't make it longer or you will be disqualified. Remember your answers to the skill testing questions are part of this 100 words.
The story should be about you and why you should win this contest, and must be mailed or e-mailed to the address listed above.
Additional information on the judging can be found under Evaluation Criteria. Provide your legal name, address, email and cell number for contact in the event that you are selected as the winner, or if your entry fee must be returned due to cancellation of the contest.
Evaluation Criteria: Skill testing questions must be answered correctly:
Judges will evaluate the contestants answers to the essay questions based on relevance and writing skill.
By participating in this contest each entrant accepts the judges decision is final. Limit: one (1) entry per person during the contest period.
There is one prize (the “Prize”) available to be won, consisting of:
The Real Property located at 2286 Bowman Road, Ottawa, Ontario.
Approximate retail value of the Prize is $1,149,000.00 CAD.
The Prize must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise.
Any other costs or expenses associated with the Prize not specified herein will be the responsibility of the selected winner including all applicable taxes, HST, land transfer tax and legal fees associated with the conveyance of the Prize.
5. Prize Claim Conditions
In order to be declared a winner, the selected entrant must:
(i) respond to notification of selection sent be the Sponsor to the email address provided when entering the House Contest within two (2) business days of first attempt by Sponsor;
(ii) (sign and return to Sponsor, within two (2) business days of it being sent by Sponsor, a written declaration and release form, releasing the Sponsor from any liability in connection with this House Contest or the use, misuse, awarding or possession of any prize (the “Release”); and,
(iii) otherwise comply with these House Contest Rules.
Return of the Prize, or any part thereof, or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to notification within two (2) business days of first attempt by Sponsor or Sponsor’s agent, failure to provide a valid email address, failure to provide proof of eligibility (if requested), release documents, or other required documentation in a timely manner, failure to correctly answer the skill-testing question, or other non-compliance with these House Contest Rules may result in disqualification, forfeiture of the Prize, or part thereof, and, at Sponsor’s sole discretion, selection of an alternate eligible entrant for the forfeited Prize, or part thereof, in accordance with these House Contest Rules, who will be subject to disqualification in the same manner.
6. Right to Void/Terminate/Suspend/Modify
This House Contest shall be cancelled if a total of at least 50,000 entries is not received on or before the House Contest end date. Sponsor reserves the right to terminate, suspend or modify this House Contest, in whole or in part, at any time and without notice or obligation if, in Sponsor’s sole discretion, any factor or event arises that could interfere with the proper conduct, administration, security or impartiality of the Contest as contemplated by these House Contest Rules. In the event of any such cancellation, the Sponsor shall return all entry monies to all entrants, less any applicable postage or bank charges.
Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the House Contest, violates the House Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person.
7. Limitation of Liability and Releases
Without limiting the generality of the foregoing, the Prize is awarded and provided "as is", without warranty of any kind, either express or implied, and the sponsor hereby disclaims all such warranties, including but not limited to, the implied warranties of merchantability, and/or fitness for a particular purpose. Notwithstanding the foregoing, the Sponsor agrees to convey the Prize to the winning entrant free and clear of any mortgages or liens.
Without limiting the foregoing, the Promotion Entities, any of Sponsor’s suppliers or contractors shall not be responsible for any technical or human error which may occur in the processing of submissions in the Contest occasioned by participation in this Contest.
8. Protection Of Personal Information
Unless otherwise authorized by the entrant, any personal information provided by the entrant when they enter the Contest will be used solely by the Sponsor and its authorized agents for the purposes of administering the Contest and prize fulfillment.
When entering the Contest, however, the entrant may give their express, opt-in consent to receive electronic messages from the Sponsor. All personal information the Sponsor or its authorized agents collect will be handled in accordance with Canadian privacy protection laws and regulations. Further, the winning entrant hereby consents to any public disclosure of the identity of the winning entrant and the content of the entrant’s winning entry.
By entering the Contest, the winner authorizes the Sponsor to use, in any media (including the Internet) in perpetuity, their name, photograph, likeness, voice and/or statement regarding the Prize for publicity and advertising purposes, without any compensation.
10. General Conditions
All entries become the property of Sponsor and will not be returned, and no correspondence will be made with or entered into except with selected entrant(s).
Contest is subject to all applicable federal, provincial and municipal laws. Sponsor’s failure to enforce any term of these House Contest Rules shall not constitute a waiver of that provision. The invalidity or un-enforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.
Should a winner make any false statement(s), the winner may be required to promptly return to Sponsor his/her prize, or the cash value thereof.
In the event of a dispute as to the identity of the person who submitted any entry, the card holder used to make the payment for entry will be deemed to be the entrant.
NO drive by: There is a multitude of photos available online and through our social media, as well as a map of the area on Google maps. Please respect our small community and do not drive by the area of the home.
NOT a lottery: As per OLG regulations, this contest is not a lottery as it is not a random draw.
NOT a promotion: As per the Competition Bureau of Canada, this contest is not promoting any organization.
Taxation: Please research the tax laws of your native country to determine any tax ramifications resulting from winning the contest before submitting your entry.
11. Governing Law
This Contest is governed by the law of Canada. Each entrant agrees, to the extent permitted by law, that any judicial proceedings relating to any disputes, claims or causes of action arising out of or in connection with the Contest shall take place in a provincial court within Ontario.
